Pirate Traders Terms of Service

1. Agreement

These Terms govern your use of the piratetraders.com website and our content, memberships (including The Pirate Traders Brigade), courses, workshops, mentorship, live streams, and email publications (together, the “Services”). By using the Services or purchasing anything from us, you agree to these Terms, our Privacy Policy (https://piratetraders.com/privacy-policy/), and, where presented, our Risk Disclosure Statement (https://piratetraders.com/risk-disclosure/). If you do not agree, do not use the Services. The cutlassedge.com website and the CutlassEdge software subscription are governed by the separate CutlassEdge Terms of Service, and the CutlassEdge desktop software is licensed under its own End User License Agreement presented in the app.

2. What our Services are, and are not

Everything we publish or present, including emails, live streams, videos, courses, workshop sessions, mentorship conversations, chat rooms, and community discussions, is general information and education about markets and trading. It is provided for educational purposes only.

We are not registered as an investment adviser or commodity trading advisor with any federal or state authority. Nothing in the Services is investment advice, trading advice, a recommendation, or a solicitation or offer to buy or sell any futures contract, security, option, or other instrument. When we discuss trades, levels, or scenarios, including anything phrased as what we would do, we are illustrating a way of thinking about markets, not telling you what to do. We do not provide personalized advice, and no communication from us, including replies to your messages, should be read as advice tailored to you.

Trading involves substantial risk of loss and is not suitable for everyone. Past performance, real or hypothetical, is not indicative of future results. You alone are responsible for your trading decisions and their outcomes. See the Risk Disclosure Statement.

3. Accounts and eligibility

You must be at least 18 to purchase or hold a membership. Keep your account credentials secure; you are responsible for activity under your account. Provide accurate information and keep it current.

4. Memberships, purchases, renewals, cancellation

  1. Billing. Membership fees, prices, and renewal periods are stated at checkout. Subscriptions renew automatically until cancelled. You may cancel at any time through your account at https://piratetraders.com/my-account/subscriptions/, effective at the end of the current billing period. If you pay through PayPal, you can also cancel from within your PayPal account. We will send a reminder before any annual renewal.
  2. Refunds.
    • The Pirate Traders Brigade: membership fees are non-refundable. You may cancel at any time under Section 4.1 and keep access through the end of the period you have paid for; your membership then does not renew.
    • Workshops: fully refundable if you cancel at least 24 hours before the session start time, by emailing ahoy@piratetraders.com. Within 24 hours of the start, and once the session has begun, workshop purchases are final.
    • CutlassEdge: the CutlassEdge desktop application is sold separately under its own End User License Agreement, which includes a thirty-day money-back guarantee for first-time subscribers.
  3. Access. Membership benefits (member emails, live-stream access, member areas, community access) are for you personally and last while your membership is active, subject to Section 7.
  4. Changes. We may change membership benefits or prices prospectively with notice; changes apply from your next renewal.

5. Intellectual property; your license to our content

The Services and all content (video, text, charts, course materials, recordings, logos, and trademarks including Pirate Traders and CutlassEdge) are owned by Pirate Traders Inc. or our licensors. You receive a personal, non-transferable, non-commercial license to access the content your purchase covers. You may not copy, share, resell, redistribute, record, or publicly post paid content, including sharing member live-stream links or course materials. Quoting brief excerpts with attribution for commentary is fine.

6. Community conduct

Our community spaces (including the member Discord) run on the Crew Code posted there. In short: be useful or be kind; no spam, scams, or solicitation; disclose your interest when recommending anything you profit from; go after ideas, not people. We may remove content or suspend access for violations of these Terms or the Crew Code, with an explanation of which rule was broken.

7. Termination

You may cancel at any time (Section 4). We may suspend or terminate access for material breach of these Terms or the Crew Code. Sections 2, 5, and 8 through 12 survive.

8. Testimonials and third-party links

Testimonials reflect individual experiences and are not typical results or promises of performance. We disclose material connections when we recommend products or services from which we may earn compensation. Linked third-party sites and services are not ours; use them at your own risk.

9. Disclaimers; limitation of liability

THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, COMPLETENESS, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIRATE TRADERS INC. IS NOT LIABLE FOR TRADING LOSSES OR FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM THE SERVICES, AND OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS IS LIMITED TO THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE. NOTHING HERE LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED.

10. Dispute resolution; arbitration; class waiver

Disputes are resolved by binding individual arbitration under the American Arbitration Association Consumer Arbitration Rules, seated in Massachusetts, with a small-claims carve-out and a thirty (30) day opt-out by email to legal@piratetraders.com, on the same terms as Section 16 of the CutlassEdge EULA. YOU AND WE WAIVE JURY TRIAL AND CLASS PARTICIPATION.

11. Mentorship sessions

Mentorship is educational conversation on a contract basis, subject to Section 2 in full. Appointments cancelled with less than 48 hours notice are billable in full.

12. General

Massachusetts law governs these Terms, without regard to conflicts rules; the Federal Arbitration Act governs Section 10. We may update these Terms; material changes will be posted with a new effective date and, for members, notified by email, and continued use after notice is acceptance. If any provision is unenforceable, the rest stands. These Terms plus the policies referenced here are the entire agreement about the Services. Notices: legal@piratetraders.com.
